Terms of Service

Daily Constitutional · Last updated: October 7, 2026 · Version 2.0

These Terms of Service ("Terms") are an agreement between you and Heavin Astern LLC ("we," "us," or "our") for your use of the Daily Constitutional app on iPhone and Android and the pages at dailyconstitutional.heavinastern.com (together, the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy at https://dailyconstitutional.heavinastern.com/privacy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old, or the age of digital consent where you live if higher, to use the App. By using it you confirm that you meet this requirement and that you can form a binding agreement.

2. Your account

3. What the App is

Daily Constitutional offers short daily lessons and quizzes about the U.S. Declaration of Independence, the Constitution, the Bill of Rights and the Federalist Papers, along with a library of the primary documents. We aim for accuracy, using primary sources such as the National Archives, and we ask for reports of inaccuracies. The App is for education and information only. It is not legal, historical or professional advice, and it takes no position on current political matters.

Lessons and quizzes need an internet connection. Primary documents in the Library can be read offline.

4. Free and Premium

5. Streaks and progress

Your streak and progress are calculated on our servers using your device's time zone. We may make adjustments to correct errors or prevent abuse. Streaks, badges and similar features are for motivation only and have no cash value.

6. Your content

Notes, highlights and bookmarks you create remain yours. You give us a limited license to store, process, display and sync them solely to provide the App to you. You are responsible for your content. We may remove content that violates these Terms or the law.

7. Acceptable use

You agree not to:

8. Our content and intellectual property

The App, its design, software, lessons, quizzes, explanations, artwork and other original content belong to us or our licensors and are protected by law. The text of the Declaration of Independence, the Constitution and the Federalist Papers is in the public domain, but our selection, arrangement and commentary are not. We give you a personal, limited, non-exclusive, non-transferable license to use the App for your own non-commercial learning. Our name, logo and branding may not be used without permission.

9. Feedback

If you send us ideas or reports, we may use them without obligation to you.

10. Third-party services

The App relies on services from Apple, Google and others. Their terms apply to your use of those services, and we are not responsible for them.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ALL CONTENT IS COMPLETE OR FREE OF ERRORS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US THROUGH THE STORES IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU PAID NOTHING. SOME PLACES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

13. Indemnification

To the extent permitted by law, you agree to defend and hold us harmless from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the App, your content, or your breach of these Terms.

14. Suspension and termination

You can stop using the App and delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the App. When your account is deleted, it is deactivated immediately and your personal data is permanently removed within 30 days (with backup copies overwritten within 90 days), as described in the Privacy Policy. Sections that by their nature should survive termination will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be brought in the state courts located in Lake County, Florida, or the federal court serving that county, and you and we consent to their jurisdiction, except where your local consumer laws give you the right to use your own courts. These Terms do not require arbitration.

16. Apple and Google

If you got the App from the Apple App Store, Apple is not a party to these Terms and has no obligation to provide support or maintenance for the App, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The same applies to Google for Google Play. Any claim about the App must be directed to us, not to Apple or Google.

17. Changes to the App or these Terms

We may update the App and these Terms. We will post new Terms here, update the date above and tell you in the App or by email if the change is material. Using the App after a change means you accept it.

18. General

These Terms and the Privacy Policy are our entire agreement with you about the App. If a part is found unenforceable, the rest stays in effect. If we do not enforce a part, we are not giving it up. You may not transfer your rights under these Terms; we may transfer ours as part of a business transaction.
